Terms of use
The agreement between you and us when you play From Ashes. We've kept it as plain as we can.
The short version
- The game is intended for players 16 and over. You need to be at least 13 to make an account (older in some countries).
- Keep your account to yourself, pick a decent username, and play fair: no cheating, hacking or harassing anyone.
- Shillings and items are a licence to use them in the game. They aren't money, have no cash value, and can't be sold, swapped or cashed out.
- Purchases are covered by our Purchases and refunds policy. Your legal rights as a consumer always apply.
- The game is still growing. Things will change, and sometimes it may be unavailable.
- If you break these rules we may suspend or close your account.
This summary is here to help. The full terms below are what apply.
About these terms
These terms are an agreement between you and [Your legal name or company] of [postal address], [country] (“we”, “us”), the makers of From Ashes (“the game”). By playing the game or making an account, you accept them. If you don't agree, please don't use the game.
Our Privacy policy, Purchases and refunds policy and Cookies and storage page also apply and form part of these terms.
Who can play
- The game includes realistic violence and is intended for players aged 16 and over. See the content notice.
- You must be at least 13 to make an account. Where your country's law sets a higher age for using online services without a parent's consent (for example 16 in parts of the European Union), you must be that age or have a parent's or guardian's consent.
- If you are under 18 (or the age of majority where you live), a parent or guardian should read these terms with you and agree to them, and must approve any purchase.
Your account
- Give a real email address you control, and keep your password private. You're responsible for what happens on your account.
- One account is for one person. Don't share it, sell it, or use someone else's.
- Your username is visible to other players. It must not impersonate anyone, be offensive, hateful or sexual, contain personal information, or use a brand you don't own. We may change or remove a username that breaks this rule.
- Tell us straight away at [contact email] if you think someone else has access to your account.
Playing without an account
If you play without signing in, or in offline mode, your progress lives only in your browser. Clearing your browser's data or switching devices will lose it, and we can't recover it for you.
Playing fair
You agree not to:
- cheat, use bugs or exploits on purpose, or edit saves, game files or network requests to give yourself shillings, items or progress;
- use bots, scripts or other automation to play or to access our services;
- attack, overload, probe or try to break into the game, its servers or other players' accounts, or get around any security measure;
- copy, reverse engineer or redistribute the game, except where the law expressly allows it;
- harass, threaten or abuse anyone, including through usernames, friend requests or bug reports;
- buy, sell or trade accounts, shillings or items for real money or anything else outside the game;
- make fraudulent purchases or chargebacks;
- use the game in a way that breaks the law.
If you find a bug or a security problem, please report it from the pause menu or by email instead of using it. We're grateful for reports and won't take action against anyone who reports a problem in good faith without exploiting it.
Shillings and items
The game has a virtual currency, Nkaro shillings (shown with a cowrie shell), and virtual items such as vehicles. You can earn shillings by playing, and you can buy them.
- A licence, not ownership. When you earn or buy shillings or items, we give you a personal, limited, non-transferable, revocable licence to use them in the game. You don't own them, and they are not your property.
- No cash value. Shillings are not money, e-money or any kind of financial product. They can't be exchanged for real money, goods or services outside the game, can't be transferred to another player or account, and we will never buy them back, except where the law requires it.
- Fixing mistakes. We may correct balances or items that come from a bug, an error, cheating, a refunded payment or a chargeback.
- Changes. We may change how shillings and items work, what things cost in shillings, and what is available, as the game develops. We won't remove things you paid real money for without a fair reason, and if we do we'll treat you fairly as described in our Purchases and refunds policy.
- Items marked “coming later” can't be bought until they exist in the game.
Purchases
You need to be signed in to buy with real money. Payments are handled by Stripe on its secure checkout page; the price you pay is the one shown there. You must be allowed to use the payment method you choose. Details about delivery, the right of withdrawal, refunds and chargebacks are in our Purchases and refunds policy.
Our game and your content
The game, including its story, characters, world, art, music, voices and code, belongs to us or the people who license it to us. We give you a personal, non-exclusive, non-transferable licence to play it for your own non-commercial entertainment, as long as you follow these terms.
Videos and streams are welcome. You may stream the game and share videos and screenshots of it, including on channels that earn money, as long as you don't suggest we endorse you and you don't share it in a way that breaks these terms.
Your username, bug reports and any feedback stay yours, but you give us permission to store and use them to run, fix and improve the game. If you send us ideas, we may use them without owing you anything.
Changes and availability
From Ashes is a game in active development. We may add, change or remove features, chapters and items, and we may need to pause the game for maintenance. We try hard to keep your progress, but in rare cases (for example a serious bug) a save may need to be reset or adjusted. If we ever decide to close the game, we'll give at least 60 days' notice in the game.
Suspension and closing accounts
You can stop playing at any time, and ask us to delete your account by emailing [contact email].
We may suspend or close your account, or remove shillings or items, if you seriously or repeatedly break these terms, if we must do so by law, or to protect other players or the game. Where it's reasonable, we'll warn you first and tell you why, and you can reply to us if you think we've made a mistake. If your account is closed because you broke these terms, you lose the shillings and items on it, except where the law gives you a right to a refund.
Disclaimers
We make the game with care, but it is provided “as is” and “as available”. To the extent the law allows, we don't promise that it will always be available, free of bugs, or suitable for a particular purpose.
Nothing in these terms takes away rights you have by law as a consumer, for example under consumer protection law in the EU or the UK, which say digital content must be as described, fit for purpose and of satisfactory quality.
Our liability
- We are not liable for losses that were not foreseeable, for loss of profits or business, or for losses you could have avoided by taking reasonable care.
- To the extent the law allows, our total liability to you for any claim about the game is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars (or the equivalent in your currency).
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law.
- If you are a consumer in the EU or the UK, we are responsible for foreseeable loss and damage caused by our breach of these terms or our failure to use reasonable care and skill.
Governing law and disputes
These terms are governed by the laws of [country]. If a problem comes up, please contact us first; most things can be sorted out quickly by email.
If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts of that country.
Changes to these terms
We may update these terms as the game changes or the law requires. We'll update the effective date, and if a change is significant we'll tell you in the game or by email at least 14 days before it takes effect. If you keep playing after that, the new terms apply. If you don't agree, you can stop playing and ask us to delete your account.
General
- These terms, together with the policies they mention, are the whole agreement between us about the game.
- If a court decides part of these terms can't be enforced, the rest still applies.
- If we don't enforce a rule straight away, we can still enforce it later.
- We may transfer this agreement to someone who takes over the game, as long as your rights under it aren't reduced. You may not transfer your rights or account to anyone else.
